Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service.

1. Age Restriction

You must be at least 13 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

2. Description of Service

CalorieGram AI is a health and fitness application designed to help users track their food intake, monitor nutritional information (calories, macronutrients, micronutrients), log activities, track health metrics (weight, measurements, etc.), and receive AI-powered insights and recommendations.

3. User Accounts

When you create an account with us, you guarantee that the information you provide is accurate, complete, and current at all times. You are responsible for maintaining the confidentiality of your account and password, including restricting access to your device. You agree to accept responsibility for all activities or actions that occur under your account and/or password.

4. Subscriptions and Payments

Some parts of the Service are billed on a subscription basis ("Subscription(s)"). CalorieGram AI currently offers the following subscription plans:

• Monthly: $2.50 USD
• Annually: $29.99 USD

Free Trial: We offer a 7-day free trial for new users. If you sign up for a free trial, you will be automatically charged the applicable subscription fee at the end of the trial period unless you cancel before the trial ends.

Billing and Payment: Subscriptions purchased through the CalorieGram AI mobile application are processed via the Apple App Store or Google Play Store ("App Stores"). Payments will be charged to your App Store account at confirmation of purchase.

Renewals: Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current subscription period. Your App Store account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellations and Refunds: You can manage and cancel your subscriptions by going to your account settings in the respective App Store after purchase. All billing inquiries, cancellations, and refund requests must be directed to the App Store where you made the purchase, as they handle the payment process. CalorieGram AI does not directly process payments or refunds for subscriptions purchased through the App Stores.

5. User Content

Our Service allows you to input, store, and manage personal health information, including food logs and data synced from connected health platforms like Apple Health and Google Health Connect ("User Content"). You retain full ownership of your User Content.

You grant CalorieGram AI a limited license solely to use, store, process, and display your User Content as necessary to provide the Service features to you (e.g., calculating nutritional information, displaying progress charts). We will not use your User Content for any other purpose, such as marketing or selling data, without your explicit consent.

You are solely responsible for the accuracy and legality of the User Content you provide or sync.

6. Use License

Permission is granted to temporarily download one copy of the materials (information or software) on CalorieGram AI's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title...

7. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of CalorieGram AI and its licensors. The Service is protected by copyright, trademark, and other laws.

8. Disclaimers

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. CalorieGram AI makes no warranties, expressed or implied. The nutritional information provided is an estimate and should not be considered medical advice. Consult with a healthcare professional before making any health decisions based on information from the Service.

9. Limitation of Liability

In no event shall CalorieGram AI, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages...

10. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. You agree to submit to the personal jurisdiction of the state and federal courts located in Delaware for any actions for which we retain the right to seek injunctive or other equitable relief.

11. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
